Welcome to AppJubilee. These Terms of Service (“Terms”) govern your access to and use of the AppJubilee platform, website, and related services (collectively, the “Service”) operated by Dark Ecommerce Labs, LLC (“Company,” “we,” “us,” or “our”), a Wyoming limited liability company.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Overview of the Service

AppJubilee is a software-as-a-service (SaaS) platform that provides Shopify App Store intelligence, including keyword ranking data, competitor analysis, review monitoring, listing change tracking, and related analytics for Shopify app developers.

2. Eligibility and Accounts

You must be at least 18 years old and capable of entering into a binding agreement to use the Service. When you create an account, you agree to provide accurate and complete information and to keep that information up to date. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

3. Subscriptions and Payment

Access to the Service requires a paid subscription. By subscribing, you agree to pay all applicable fees as described at the time of purchase. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. All fees are non-refundable except where required by law or as expressly stated in a promotional offer.

We reserve the right to change pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Data You Provide and Connect

4.1 Third-Party Integrations

The Service allows you to connect third-party accounts, including but not limited to your Shopify Partners account and Google Analytics 4 (GA4) account, via OAuth or API credentials. By connecting these accounts, you authorize us to access and retrieve data from those services on your behalf in accordance with this agreement and our Privacy Policy.

4.2 User-Submitted Data

You may also submit data to the Service manually, including but not limited to keywords, app identifiers, and other inputs (“User-Submitted Data”).

4.3 Use of Your Data to Improve the Service

By connecting third-party accounts or submitting data to AppJubilee, you grant Dark Ecommerce Labs, LLC a non-exclusive, worldwide, royalty-free license to use, process, aggregate, and analyze that data — including data from your GA4 account, Shopify Partners account, and any manually submitted keywords — to operate, improve, and enhance the Service.

This means your data may be combined with data from other users to produce aggregated, anonymized metrics, benchmarks, insights, and platform-wide intelligence that benefit all users of the Service. For example, keyword data contributed by users may be used to generate estimated search volumes, trend data, and broader market intelligence available across the platform.

We will never sell your raw, identifiable data to third parties. Any aggregated data derived from your inputs will be anonymized such that it cannot reasonably be attributed to you or your specific app.

4.4 Your Responsibilities

You represent that you have the right to share any data you connect or submit to the Service, and that doing so does not violate any agreement you have with a third party, including the terms of service of Shopify, Google, or any other platform.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service.
  • Scrape, crawl, or otherwise programmatically access the Service outside of the provided interfaces and APIs.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Share your account credentials or allow unauthorized access to your account.
  • Resell, redistribute, or sublicense access to the Service or its data without our prior written consent.

6. Intellectual Property

All content, features, functionality, data compilations, algorithms, and visual design of the Service are and remain the exclusive property of Dark Ecommerce Labs, LLC or its licensors. Nothing in these Terms grants you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

You retain ownership of the raw data you connect or submit. However, the aggregated and derived data products we create using that data (as described in Section 4.3) are the property of Dark Ecommerce Labs, LLC.

7. Data Accuracy and Disclaimer

The data and analytics provided by the Service are derived from a combination of proprietary scraping, third-party APIs, and user-contributed data. While we strive for accuracy, we do not guarantee that any data, ranking, metric, or insight is complete, current, or error-free.

The Service is provided for informational purposes and should not be the sole basis for business decisions. You acknowledge that Shopify App Store rankings, search algorithms, and related data are controlled by Shopify and may change without notice.

8. Limitation of Liability

To the maximum extent permitted by law, Dark Ecommerce Labs, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Dark Ecommerce Labs, LLC, its officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 6, 8, 9, and 11) will survive.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Wyoming, and you consent to personal jurisdiction in those courts.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service at least 15 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
